These terms govern your use of the store and your purchases. By placing an order you agree to them.
This store is operated by The Austrian Painter LLC ("we", "us", or "our"), a limited liability company organized in the United States and based in Denver, Colorado. These terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules. If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full effect.
Ordering & eligibility
To place an order you must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract. You agree to provide accurate and complete order and shipping information. We are not responsible for delays or failed deliveries caused by incorrect details entered at checkout.
When you place an order you are making an offer to purchase, which we may accept or decline at our discretion — for example, if an item or option is unavailable, if there is an error in the price or product description, or if we suspect fraud or misuse. If we decline your order after you have been charged, we will refund the amount paid.
Products — made to order
Our products are custom-printed to order and fulfilled by our third-party print partner. Because each item is individually produced, minor variations in color, tone, and finish can occur from one print to the next, and between what you see on your screen and the finished product. These natural variations are inherent to the printing process and are not considered defects.
We take care to describe and show our products accurately, but we do not warrant that product images, colors, or descriptions are error-free, or that your device displays colors exactly as they appear in the finished piece.
Orders, cancellation & payment
Payment is authorized when you place your order and captured shortly after. You may cancel for a full refund only before your order enters production; once in production it cannot be cancelled or changed. This mirrors our Returns & Refunds policy — keep the two consistent.
The cancellation window and the terms for cancelling before or after production match our Returns & Refunds policy in full; if there is ever any inconsistency between the two, the Returns & Refunds policy governs cancellations and refunds. We accept payment by major credit and debit cards, processed securely by our payment provider, Stripe; we do not receive or store your full card number. All prices and charges are in US dollars, and any applicable sales tax is calculated and shown at checkout before you pay.

Returns, refunds & defects
Returns, refunds, and handling of damaged, defective, or incorrect items are governed by our Returns & Refunds policy.
Public domain artwork & acceptable use
The artworks we sell are in the public domain. We do not own, and we make no copyright claim to, the underlying paintings or images reproduced on our products. Under United States copyright law, published works enter the public domain 95 years after publication, so works published in or before 1930 are in the US public domain as of January 1, 2026. In many other countries — including an artist's home country in Europe — a work generally enters the public domain 70 years after the artist's death. We offer only works that we have determined, in good faith, to be in the public domain on this basis.
Because these works are in the public domain, you are free to use the underlying artwork itself as you wish; nothing you purchase from us restricts that freedom. A faithful photographic reproduction or scan of a public-domain artwork does not create a new copyright, so we claim no ownership of the images of the artworks themselves.
Our own original materials are separate from the public-domain artwork and remain the property of The Austrian Painter LLC or its licensors. These include our store name and branding, the design and layout of this website, our original photography (such as staged product and lifestyle images), and our written descriptions and other site text. Please do not copy or reuse these original materials without our permission. You also agree not to use the store unlawfully, interfere with its operation or security, or attempt to access it in any unauthorized way.
Public-domain status concerns copyright. In rare cases a work or its subject may carry other rights, such as trademark or personality rights; where that applies, those rights are unaffected by these terms.
Disclaimers & limitation of liability
The store and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these terms, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these terms limits any rights you have under mandatory consumer-protection laws that cannot legally be waived.
To the fullest extent permitted by law, our total liability to you for any claim arising out of or relating to your order or your use of the store will not exceed the amount you paid for the order giving rise to the claim, and we will not be liable for any indirect, incidental, or consequential damages.
Changes to these terms
We may update these terms from time to time. When we do, we will post the revised version on this page and update the date shown at the top. Changes apply to orders placed after the revised terms are posted, and your continued use of the store means you accept them.
